What is an Asbestos Re-inspection?

An asbestos re-inspection must take place, as a minimum, every 12 months according to the Approved Code of Practice (The Control of Asbestos Regulations 2012). It is your legal duty to comply with these regulations and regularly assess ACMs for any damage, tears or any changes that affect the safety of your property. Failure to comply can result in HSE enforcement action, including fines, prosecution, or even imprisonment in severe cases.

The Control of Asbestos Regulations (2012)

The duty holder is responsible for identifying and managing asbestos in non-domestic premises.

Who is Dutyholder?

• Anyone with contractual or tenancy obligations for maintenance or repair of non-domestic premises, including access/exit routes.
• Anyone in control of part (or all) of non-domestic premises where no such contract or tenancy exists.
• Where more than one duty holder exists, responsibility is shared according to the nature and extent of their obligations.
• Everyone must cooperate with the duty holder to help them fulfil their legal duties.

Identifying Asbestos Risks

Dutyholder must:
• Carry out a suitable and sufficient assessment to determine if asbestos is present or likely to be present.
• Take reasonable steps in the circumstances.
• Consider the condition of any identified or suspected asbestos.
Assessment must include:
• Reviewing building plans and other relevant information.
• considering the age of the premises.
• Inspecting reasonably accessible areas.

Risk Management Plan

If asbestos is present or suspected, the duty holder must:
• Determine the level of risk.
• Prepare a written management strategy plan identifying affected areas.
•Specify measures for managing the risk.

Required Measures in the Plan

• Ongoing monitoring of asbestos condition.
• Proper maintenance or safe removal where necessary.
• Providing asbestos location and condition information to anyone who may disturb it and any emergency services.
• The plan must be reviewed regularly and updated immediately if it is no longer valid or the premises change significantly.
• The duty holder must implement the plan's measures and keep records of actions taken.
